Scott Klein is a member of the Firm’s Commercial Litigation Department.
Scott has a wealth of experience in all phases of commercial litigation, from pre-litigation strategy through and including appeal. He represents and advises clients in a wide range of matters, including employment disputes; state and federal appellate matters; commercial real estate disputes (including Yellowstone Injunctions); partnership/shareholder disputes; family business disputes; contract disputes; construction litigation; fiduciary duty beaches, fraud, conversion, and related business torts; and government investigations.
Scott has developed particular expertise in defending against and enforcing restrictive covenants in employment agreements (non-competition, non-solicitation and confidentiality agreements), successfully defending against numerous preliminary injunctions sought in New York’s state and federal courts.
Scott also has extensive experience in arbitrations, mediations and other forms of alternate dispute resolution, often appearing before AAA, NAM and JAMS.
Clients rely on Scott’s skills in providing strategic, legal and practical advice on how best to proceed through the often-uncertain world of commercial litigation. Prior to joining Mintz & Gold LLP in 2001, Scott served as an Assistant District Attorney in Bronx County for 5 ½ years, serving as lead chair in twelve felony jury trials and supervising several long-term wiretap investigations.
Scott received his B.A. from Tufts University in 1990, where he was elected captain of the basketball team, and his J.D. degree from Brooklyn Law School in 1995, where he served on the Moot Court Team.
Represented son in a multi-million dollar dispute with his father regarding family business;
Represented staffing firm in connection with non-competition; non-solicitation and trade secret disputes in multiple jurisdictions;
Defended accounting firm in an employment dispute with a competing firm;
Represented national real estate broker in dispute with its landlord;
Defending large oil and gas fund in claims brought by some of its investors;
Represented large media company in employment and contract-based disputes;
Argued numerous appeals before the First and Second Departments in New York.
Served as co-first chair lawyer for a federal court jury trial in a breach of contract dispute;
